Defence Focus: Court passes order on petitions against the Agnipath scheme

The Agnipath Scheme is a new initiative launched by the Government of India on 14 June 2022, to recruit soldiers under the rank of officers deployed in three military operations. The Agnipath Scheme will be the only alternative for military recruitment. All employees will be employed for a term of only four years which will be a new level of military. The launch of the program has been criticized for not consulting with the public debate. The program is scheduled to be operational from September 2022.

This plan will surpass many factors including longevity, pensions and other benefits that were available in the old system. Opposition groups in India have criticized and expressed concern over the effects of the new system. They called for the suspension of the process to be debated in Parliament.

On June 16, 2022, violent protests erupted in several states in India in which angry militants demanded a new system demanding the return and damage to public property. On June 17, 12 trains were set on fire, and 300 trains were affected. 214 trains were canceled, 11 were diverted, and 90 were discontinued at their destination. The institute issued a warning to the Supreme Court and requested that a hearing be held before the court issued any order regarding complaints about the Agnipath program. The Agnipath program, announced June 14, provides employment for young people between the ages of 17.5 and 21 for four years with the provision of a final 25 percent of it for another 15 years. Protests have erupted in many provinces against the plan. Later, the government added the age limit of more than 23 to employ people by 2022 Agnipath program.

The petition, filed by Adv Harsh Ajay Singh, called for a constitutional directive from the committee to provide the Department of Military Affairs, the Ministry of Defense, and to invite proposals, including retired Army officials, for comment amendments to the job creation plan for 75% of Agniveers, after retirement. Respectfully submitted that the applicant is genuinely concerned with the rule of law and order in the country and invites the views of the country’s youth whose future is at hand on the stake, said the petition, filed by attorney KumudLata Das.

He said the plan would be implemented from June 24 and the announcement of the Agnipath plan had sparked protests across the country in various provinces, including Bihar, Uttar Pradesh, Telangana and West Bengal, over a short four-year period uncertainty of trained Agniveers .The list of complaints suspects that this is a slow and highly effective change. There are various shortcomings in this change and as more is discussed a better change would be made, he said. The high probability that Agniveers trained under the program is missing and a four-year recruitment is not enough to instill the values ​​and ethics of the Indian subcontinent. The applicant also sought to continue using the program.

Two cases have been filed in the high court over the issue. One of the appeals is for an order to establish a special investigative team (SIT) to investigate the damage to public buildings, including Railways, and violent protests against Railways Agnipath Scheme Center. The application requested requests from the Center and the governments of Uttar Pradesh, Telangana, Bihar, Haryana and Rajasthan to submit a report on the status of the violent protests. We also sought guidance to establish an expert committee under the chairmanship. A retired high court judge examines the plan and its impact on national security and the Armed Forces. Another high court case against the Center’s Agnipath program alleges that the government has spent a century in the selection of armed soldiers contrary to the provisions of the constitution and without the approval of parliament.
