SC acquitted 3 men convicted by a lower court of mass murder in Haryana

Almost a month after the Supreme Court acquitted three men convicted by a lower court of mass murder and the murder of a 19-year-old woman, the family has now sought a review of the order. The 19-year-old was kidnapped from Delhi and later found dead in Haryana. The petition for review was filed on behalf of the woman’s father.

“We have filed a petition for review on behalf of the victim’s parents. There have been some issues that have not been brought to the attention of the Supreme Court. Our request is that the order be reversed and the order passed by the trial court be upheld.” The Supreme Court should be upheld,” advocate S Sharma told reporters.

Last month, a three-judge bench headed by former Chief Justice of India (CJI) Uday Umesh Lalit said, “In view of the totality of the circumstances and the evidence on record, it is difficult to say that the prosecution has established the guilt of the accused by presenting cogent and convincing evidence.”

The petition points out that “there are obvious errors in the judgment of the Supreme Court of November 7”. The Supreme Court “ignored crucial evidence,” he points out, adding that “minor discrepancies in testimony were given undue weight.” Adequate evidence was present on the recording in the form of a DNA match, recordings of call details, he further points out.

The plea also required a public hearing in court. About two weeks ago, Delhi also challenged the high court’s order in an appeal, which was approved by Lt. Governor Vinai Kumar Saxena. The acquittal of the three men in the case that sparked huge outrage comes nearly 10 years after the woman, who hailed from Uttarakhand’s Pauri Garhwal district, was abducted in Delhi. She was found dead in a field in Rewari district of Haryana. On February 9, 2012, she got off a bus about 10 minutes from her home in Chhawla camp in the state capital. She was working with a private company in Gurugram’s Cyber City and was walking home with two friends when the men kidnapped her in a car.
