Azam Khan is released from UP prison after 27 months; son says SC ‘does justice’

Samajwadi Party leader Azam Khan was released from the Sitapur district prison in Uttar Pradesh on Friday morning, a day after the High Court granted him temporary bail in a fraud case involving the Kotwali police station in Rampur. Azam Khan has been jailed for more than two years on a number of charges including land grabbing. He was granted bail in 88 of 89 cases and an interim bail application by the High Court opened the way for his release.

A prison official said a letter of release was received around 11pm on Thursday and the SP leader was released around 8am on Friday after following all the procedures, PTI media reported. Khan, on his release, was welcomed by his sons Abdullah Azam Khan and AdeebAzam Khan, the leader of the Pragatisheel Samajwadi Party (Lohiya) Shivpal Singh Yadav and a large number of supporters.

“The Supreme Court has provided justice,” said Abdullah Azam Khan, a Member of Parliament for Suar region, before his father was released from the Sitapur district prison.”I am very happy (by order of the High Court). We will go straight to Rampur (after the release),” ANI quoted Adeeb Azam Khan as saying.

On Thursday, a bench headed by Justice L Nageswara Rao granted Khan temporary bail in a fraud case, saying it was a fair offense to exercise his supreme powers under Section 142 of the Constitution as the facts in this case are very rare.

“The applicant is ordered to be released on temporary bail in respect of FIR Case Crime No.70 of 2020, registered with Police Station Kotwali, Rampur, Uttar Pradesh on charges under Section 420 (cheating) and 120B (criminal conspiracy) of the Indian Penal Code in that case. “The terms and conditions are found to be appropriate by the trial court,” Rao said.

The bench noted that “under normal circumstances, we would not have listened to the written request. The applicant would have been told to use the remedy found in his law. However, the facts in this case are very different.”
