Indian Government to Introduce Telecommunications Bill 2023 in Lok Sabha on December 18

The Indian government is set to introduce the Telecommunications Bill 2023 in the Lok Sabha on December 18, aiming to replace the longstanding Indian Telegraph Act that has governed the telecommunications sector for 138 years. The new legislation, approved by the Cabinet in August, is designed to address contemporary challenges and regulatory needs in the rapidly evolving telecommunications industry.

The draft Telecommunications Bill of 2023 proposed significant changes, including bringing over-the-top (OTT) services like internet-based calling and messaging apps under the definition of telecommunications to enhance user safety. It also sought to limit the authority of the Telecom Regulatory Authority of India (TRAI), sparking concerns among industry players.

However, government officials have indicated that concerns related to OTT players and the role of TRAI have been resolved before the bill’s approval by the Cabinet. The proposed legislation aims to modernize the regulatory framework governing the telecommunications sector in India and streamline certain rules, such as the refund of fees for licenses and registrations when a company surrenders its permit.

The introduction of the Telecommunications Bill 2023 represents a significant step toward fostering a conducive environment for the telecommunications industry in India, balancing regulatory requirements with the evolving landscape of communication services.
