The Haryana government has withdrawn the Haryana Organized Crime Control Bill, 2020 after the Center pointed out “certain irregularities”. The bill had special provisions for the prevention and control of criminal activity by organized crime syndicates or gangs. Also, the 2019 version of the law was withdrawn after several comments on certain provisions, after which a revised version was presented in 2020. But that too was taken back after the Ministry of Law and Justice and the Finance Ministry pointed out certain “irregularities” at the Centre. The new bill will be moved later.
Haryana Home Minister Anil Vij moved a resolution in the Assembly
Certain provisions of the Haryana Organized Crime Control Act, 2020 were also found inconsistent with the provisions of the Narcotic and Psychotropic Substances Act. Haryana Home Minister Anil Vij moved a resolution in the Assembly on Monday to withdraw the Bill, 2020.
The Haryana Organized Crime Control Bill, 2020 was passed by the Assembly on 6 November 2020 and the Governor kept it for consideration by the President of India under Article 201 of the Constitution. On 5 November 2020, Vij proposed a resolution to withdraw the Haryana Control of Organized Crime Act, 2019, which was passed by the Assembly on 4 August 2019.
At that time, on a request by the Ministry of Electronics and Information Technology by the Union Ministry of Home Affairs, it was pointed out that the wiretapping provision as proposed in Section 14 of the 2019 Bill was already included in the Indian Telegraph Act, 1885, and the Information Technology Act of 2000.
According to the resolution submitted by Vij on Monday, the bill was sent to the Ministry of Interior for the President’s approval. Based on the request of the Union Ministry of Law and Justice and the Ministry of Finance, Department of Revenue, certain irregularities were found by the Ministry of Law and Justice and further some provisions of the bill were found to be in conflict with the provisions of the Narcotic Substances and Drugs Act. The Act on Psychotropic Substances by the Ministry of Finance, Department of Revenue,” reads the resolution.
The Home Ministry told the Haryana Governor’s Office, “The State Government is requested to consider withdrawing the Bill from this Ministry and bring a new Bill after duly incorporating the suggestions of the Legislature Department, Ministry of Law and Justice”.The matter was discussed and it was decided to ask the Union Ministry of Home Affairs to return the bill as Haryana intends to send a revised bill taking into account the comments of the Ministry of Law and Justice and the Ministry of Finance, the resolution stated.
“The Chief Minister of Haryana, exercising the authority of the Council of Ministers, has decided to withdraw the bill. “Now, in accordance with the provisions contained in Article 200 and 201 of the Constitution of India, the State Legislative Assembly hereby decides to withdraw the Bill,” Vij said while reading the resolution.
