The Center on Wednesday filed a fresh affidavit in the same sex marriage case in the Supreme Court, seeking input from states and union territories on the issue as a party to the case.
“According to the affidavit, the matter falls under the legislative domain and therefore views of all states and UTs are necessary,” the center said in the affidavit. With the Supreme Court hearing proposals to legalize same-sex marriages, the Center has opposed granting legality. She said petitions seeking the legality of same-sex marriage reflected “urban elitist views for the purpose of social acceptance”.

The Indian Psychiatric Society’s position that homosexuality is not a disease played a key role in the Supreme Court striking down Article 377, which criminalized homosexuality, on 6 September 2018. The Center now wants states and UTs to become parties to the case and will have to submit their views within 10 days.
